Dear all,
The above mail describes how vulnerable the people working on mining industry are, first due to the monopoly of Coal India in this sector and the uncertainties arising due to policy paralysis at higher legislative and judicial level.
Many hands are on the verge of losing their jobs hence affecting many lives just by a single stroke of hand of judiciary.
The reason behind such harsh judgment is obvious. First it signifies the supremacy of law above all. Second, it sends a warning that absence of a proper law or existing loopholes in any policy can never justify any unlawful and manipulated act of corruption. Thirdly, it puts a future deterrence on those players who get induced by the lucrative but corrupt ways of manipulating the laws. Fourth, the most important outcome, it enhanced the good faith of a common man in our nation's judicial system.
More importantly, the unlawful acts happening in mining industry can never be justified on the mere ground that unlawful activities are prevalent in other sectors too.
But this judgment doesn't alone solve all other problems arising because of its own. The ill effects like fear of losing jobs by the persons in this sector, huge economic losses suffered by the banks and coal shortage to power industries
must be addressed urgently, so that none of the innocent feel getting punished for the crime he never committed.
Certain solutions like lateral entries in public sector mining companies at all levels that are facing shortage of workforce and splitting Coal India to promote competition thus ensuring smooth coal supply to power industries will be appreciated.
NGO's role can never be neglected, in bringing the environmental concerns in public notice. Finally, these are the people, government and judiciary, who decide the authenticity, relevance and severity of such concerns.
"As things become worse before they get better", the same thing applies here to mining industry that has been neglected since decades.
This can be seen as an opportunity to start again and to fabricate a fairer policy on a 'Tabula Rasa'.

Today mining industry is facing the worst problems it has ever faced, we mining engineers feel that we are illegal because everything done in mining is illegal. I would like to ask is there any industry where bribes are not taken or corruption free? In the railway run by the Govt. the very first day for reservation, you are in the waiting list.
Goan mining has become illegal and all the mines are stopped for the last 2 years. In every industry there are violations we cannot stop them all. For example: There will be many private buses running in New Delhi without proper documents; can we ban all the buses from plying until they are all checked? What will be the situation?
Today we are ruled by word not spirit; it is not the court or the Govt. at fault it is we. We have encouraged NGOs, who have used RTI to black mail the companies(mining hit most today). What are the productive jobs that these NGOs do? NOTHING. Where are they financed from? They spend huge amount of money to engage top lawyers to fight their cases, where is this money coming from? Has anyone questioned that?
Is it given anywhere in the ACT that leases have to be AUCTIONED? If 'no' then is auctioning legal?
This long illustration might have given you my opinion.
All our Indian Private Companies are capable in running mines in Safe, Systematic & Legal manner.

Suggestive Measures :
External :
(a) Coal India /Ministry of coal is the owner of these coal blocks must have an arrangement for employment of mining people was earlier engaged in development/working mine of cancelled Coal blocks. Coal India has a lot of vacant statutory mining positions. These positions must be fulfilled immediately through lateral employment by deployment of salutatory persons from these de allocated coal blocks.
(b) An immediate arrangement must be start by Indian Government in continuation with programmed development of these blocks with a given priority . So the associated supplier and others shall be reengaged which were already engaged their in.
(c) To frame a guideline by GOI for safeguard the bankers against these type of losses due to manmade/unnatural disasters.
Internal :
It is urge to all retired respected senior s Mining Peoples to come forward and create a way or positions for the Mining People having their age less than 60 Years.
Request :
Is a Coal Mining Blocks will Run properly by others Indian groups if Tatas, Jindals,ABG ,Reliance are kept outside? Y/N
Put your opinion for petitioner advocate Mr. M. L. Sharma . Good= Yes, No= Bad.
