Whether you had got your promotion or not after passing the second class exam does not matter for getting the required experience of Asst Manager (required for 1st class exam).

It is sufficient if the Mine management is ready to give you that experience certificate. And I am sure, the Mine Management won't have any problem to give you the experience certificate, provided you had been given the authorization to work as Asst Manager during that period. In many cases, the Manager of the Mines gives authorization to persons on production of Provisional Certificates of DGMS; because everybody (including DGMS officials) knows that it takes some time to get the Original certificate after passing the exam.

I hope this clarifies your doubts.

Its a matter of sorrow that after having competency certificate one is not promoted to the position he deserves. But the reality is that this    thing happened to lot of people. 
You should have submitted your second class certificate to dgms  before appearing for first class exam. 

As you received your second class late you could have got your experience as assistant manager (from) any date after of your w.e.f date of second class. Managers normally give that certificate though you work as foreman.
Now your case has become complicated. Either you have to wait until total experience is gained by you or have to replace (?) the experience certificate submitted for first class with fresh certificate as suggested above.  

As far as circular concerned one circular says that no person should hold a statutory position unless he possesses the required certificate. 

Those who don't get their certificates from dgms in time after submission of required documents,  please send 2/3 letters. If you still have delays you may post your grievance to www.pgportal.gov.in under ministry of labour and employment giving all details.

Pls. Clarify.



1. i am a diploma holder and was working as mines foreman for 5 years. i had cleared 2nd class managers competency exam on 2012 but did not promoted to assistant manager for 1 year as there was delay to get my competency certificate and also did not get promossion even after submission of the same certificate to my comapany but working as shift incharge as there was shortage of assistant manager. now i have cleared 1st class manager`s competency exam in the year 2014 on the basis of giving total 5 years of experience after diploma without submission of my 2nd class certificate. now my total experience as an assistant manager is only 1 year though it has been completed 3 years after i cleared my 2nd class exam.



so pls suggest me how i get my 1st class manager`s certificate.




2. if a person can not be promoted to assistant manager without getting the competency certificate  though he has cleared the exam according to DMS, Chainbasa how he can act as an assistant  manager/ manager when authorized because some management do this.



3. if the regulation,rule, act and bye- laws are same how the version or action of the DMS of different zones varries.



Kindly suggest is there any circular that a person can act as any statutory position without competency certificate having qualification and experience for the same position because sometimes getting the certificate from DGMS,Dhanbad becomes late.
