Dear Mr. Manoj,
Their are two situations.
1. Surface Rights for using the Mine lease hold area for ,developing
infrastructure/allied activities necessary for operation of mine.
2.Surface Rights for using Outside Mine Lease hold area, adjacent to mine.
In first case you need to give the justification/undertaking,for
obtaining surface right for establishment of Viz. Mine Canteen,Mine
Office, other infrastructure, (generally happens where constraint of
availablilityof Land exists), formeeting statutory compliance, with
the condition that the UG property shall be extracted at the later
stage.
In second case, surface rights can be obtained by mere land
acqusition,with the justification that land required for allied infra
development for mine.
However, such land/infra will be treated within Mine boundary and
attracts the Mines Act .
